L’ordinanza 4 maggio 2026, n. 12518, relativa a un trust interno regolato dalla legge di Jersey, conferma il rigetto della domanda di devoluzione anticipata della quota di un fondo ormai liquido. Il contributo ne propone una lettura restrittiva, ricostruendo la rule in Saunders v Vautier e distinguendo la cessazione dell’intero trust dall’attribuzione pro-quota. Decisiva non è l’esistenza di una clausola espressa di liquidazione, ma la titolarità, sulla quota richiesta, dell’intero beneficial interest — capitale e reddito — vested and indefeasible, avente ad oggetto beni divisibili e non inciso da interessi concorrenti. Il termine di durata non integra di per sé una condizione; l’art. 43 disciplina la cessazione del trust nel suo complesso. Sono infine considerati i limiti derivanti da passività, poteri discrezionali e indivisibilità dei beni, oltre al profilo dell’accertamento del diritto straniero.
The author’s view
The Italian Supreme Court’s Order No. 12518 of 4 May 2026, concerning an Italian domestic trust governed by Jersey law, upholds the dismissal of a claim by an individual beneficiary for the early distribution of their share of a trust fund that had become liquid. This article argues for a narrow reading of the decision, reconstructing the rule in Saunders v Vautier and distinguishing termination of the trust as a whole from a pro-quota distribution. What is decisive is not the existence of an express distribution clause, but whether, in respect of the share claimed, the beneficiary holds the entire beneficial interest -both capital and income - which is vested and indefeasible, relates to divisible assets, and is unaffected by competing interests. A fixed trust term does not in itself amount to a condition; Article 43 governs termination of the trust as a whole. The article also examines the limits arising from liabilities, discretionary powers, and the indivisibility of assets, together with the procedural issue of ascertaining the content of foreign law.
