Il contributo riflette su diversi aspetti legati all’utilizzo delle criptovalute, con specifica attenzione alla loro rilevanza ai fini del concetto di “property” inglese, nonché alle modalità di circolazione. La trattazione origina dalla pronuncia della High Court of Justice sul caso di una frode incentrata sull’utilizzo di criptovalute che, per loro natura, viaggiano nell’oscurità e rendono dunque inutilizzabili le tecniche investigative ordinarie.

La complessità del tracciamento diviene dirimente ai fini della soluzione indicata dalla Corte, soprattutto in relazione all’insorgere di un constructive trust: infatti, quando si è in presenza di fraudolenti trasferimenti di proprietà, le tutele che con tale peculiare strumento vengono riconosciute al truffato potrebbero indebolirsi in presenza di sempre nuove tecnologie, che — come visto nella sfortunata vicenda — possono anche ormai riguardare gli scambi di valute in continua evoluzione nella società.

The complexity of tracing becomes crucial for the solution indicated by the Court, especially in relation to the creation of a constructive trust: in fact, when fraudulent transfers of property occur, the protections afforded to the defrauded party by this unique instrument could be weakened by the advent of new technologies, which — as seen in this unfortunate case — may now also affect the ever-evolving currency exchanges in society.
