Il trust del Québec è un’istituzione giuridica unica nel suo genere, radicata nei fondamenti bijuridici che caratterizzano il panorama giuridico della provincia. Si basa sulla teoria del patrimonio per appropriazione: un patrimonio autonomo, distinto da quelli del disponente, del trustee e del beneficiario, sul quale nessuno detiene diritti di proprietà. Questa struttura non ha un vero equivalente nelle tradizioni di diritto civile continentale. Eppure essa informa l’intera architettura del diritto privato del Québec, che si articola attorno a due regimi distinti: da un lato, un regime di amministrazione privata fondato sull’esercizio di poteri privati e sul dovere fiduciario; dall’altro, il regime classico incentrato sulla proprietà e sulla responsabilità personale. The author’s view

The Quebec Trust is a singular legal institution, rooted in the bijural foundations that shape the province’s legal landscape. It is grounded in the theory of the patrimony by appropriation: an autonomous patrimony, distinct from those of the settlor, the trustee, and the beneficiary, and over which none holds any property rights. This structure has no true equivalent in continental civil law traditions. Yet it informs the whole architecture of Quebec private law, which is articulated around two distinct regimes: on the one hand, a regime of private administration grounded in the exercise of private powers and fiduciary duty; on the other, the classical regime centred on ownership and personal liability. While this distinctive trust framework offers considerable flexibility, it also gives rise to important risks of abuse.
