Il rendiconto che il trustee estero deve ai beneficiari italiani non è un adempimento contabile accessorio, ma il terreno su cui si misura la portata dell’ufficio fiduciario in un contesto plurilegislativo: la legge regolatrice del trust, la legge processuale del foro e le discipline fiscali dei diversi ordinamenti non compongono un sistema coerente, ma si sovrappongono e talvolta collidono. Superata, dopo Schmidt v Rosewood, la lettura proprietaria del diritto all’informazione, occorre riconoscere che la fonte dell’obbligo di rendiconto — riservata alla legge regolatrice dall’art. 8 della convenzione de L’Aja — resta separata dagli strumenti coercitivi della lex fori, di cui l’astreinte dell’art. 614-bis cod. proc. civ. è solo l’espressione più recente; e che la distinzione fra capitale e reddito non sopravvive ai criteri fiscali nazionali, imponendo un rendiconto parallelo. Ne discende che i rischi del trustee estero si prevengono nell’atto istitutivo, non nel contenzioso: la compliance italiana è componente strutturale dell’ufficio, non onere accessorio.

The author’s view

A foreign trustee's account to Italian-resident beneficiaries is no bookkeeping formality: it is where the fiduciary office's scope is tested, as the law governing the trust, the procedural law of the forum and the tax regimes of the systems overlap and collide rather than cohere. After Schmidt v Rosewood displaced the proprietary reading of the beneficiary's right to information, the duty to account — reserved to the governing law by art 8 of the Hague Convention — remains distinct from the coercive tools of the lex fori, of which the astreinte under art 614-bis of the Italian Code of Civil Procedure is only the latest instance; and the distinction between capital and income does not survive national tax classifications intact, forcing a parallel account. Foreign-trustee risk is thus prevented in the trust instrument, not managed in litigation: Italian compliance is a structural part of the office, not an ancillary burden.
