L’esecutore testamentario di diritto italiano e il trustee in common law hanno una comune origine nel fideicommissum confidentiale o fiduciarium e la loro disciplina presenta numerosi punti comuni.

Le funzioni di esecutore testamentario possono essere affidate a un trustee nella veste di erede fiduciario, un istituto del diritto comune da ritenere tuttora vigente in diritto italiano.

The author’s view

The testamentary executor under Italian law and the trustee in common law have a common origin in the fideicommissum confidentiale or fiduciarium and their regulations still have numerous points in common.

The functions of testamentary executor may be entrusted to a trustee acting as a fiduciary heir, an institution of the ius commune that is still considered to be in force in Italian law.
