Pet-trust e tutela dei diritti della Natura. Nuovi approcci a un tema emergente

Il tema dei “diritti della Natura” ha impegnato il dibattito giuridico sin dagli anni ’70. Oggi torna di prepotente attualità sospinto dall’emergenza climatica in atto. L’urgenza della tutela richiesta mal si concilia con i tempi lunghi necessari per l’approvazione di leggi e con e gli esiti incerti delle cause promosse per il riconoscimento e la tutela degli esseri viventi non umani. In questo scenario l’impiego del pet-trust appare utile a superare queste difficoltà e a realizzare un percorso di tutela più snello in attuazione dei precetti della Costituzione italiana.

The author’s view

The issue of “rights of Nature” has been a topic of legal debate since the 1970s. Today, it is once again a hot topic, driven by the current climate emergency. The urgency of the protection required is at odds with the long time needed for laws to be passed and the uncertain outcomes of lawsuits brought for the recognition and protection of non-human living beings. In this scenario, the use of pet trusts appears useful in overcoming these difficulties and creating a more streamlined protection process in accordance with the Italian Constitution.
