La pronuncia del Tribunale di Venezia merita di essere condivisa nella parte in cui ritiene applicabile l’art. 111 cod. proc. civ. alla successione tra trustee intervenuta nel corso di una procedura esecutiva su beni in trust, conseguentemente escludendo che il nuovo trustee possa ritenersi estraneo all’esecuzione cui aveva partecipato il trustee precedente. Non merita invece condivisione la complessiva lettura dell’istituto, da valutare – alla luce dell’ormai consolidata ricostruzione della posizione processuale ricoperta dal trustee nelle controversie che coinvolgono beni in trust, e cioè come trustee nella sua qualità – alla stregua di una successione in tale qualità.
The author’s view
The ruling of the Court of Venice deserves to be endorsed insofar as it holds that Article 111 of the Code of Civil Procedure applies to the succession between trustees that took place during enforcement proceedings concerning trust assets, thereby ruling out the possibility that the new trustee might be regarded as unconnected to the enforcement proceedings in which the previous trustee had participated. However, the overall interpretation of the legal concept does not merit endorsement, as it should be assessed – in the light of the now well-established understanding of the procedural position held by the trustee in disputes involving trust assets, namely as a trustee in that capacity – on the same footing as a succession in that capacity.
