La sentenza della Corte d’appello di Venezia affronta una questione centrale nel diritto dei trust: la legittimazione del beneficiario di un trust discrezionale ad agire in giudizio per ottenere il risarcimento dei danni nei confronti del trustee.

Dal punto di vista teorico e pratico, la pronuncia contribuisce a delineare con maggiore chiarezza i limiti dei poteri del trustee e i contorni della posizione giuridica dei beneficiari di trust discrezionali, i quali non sono titolari di un diritto soggettivo bensì di una mera aspettativa. In tal modo, la sentenza offre una chiave interpretativa utile per comprendere le dinamiche interne al rapporto fiduciario e per orientarsi nei conflitti che possono insorgere fra trustee e beneficiari.

The author’s view

Judgment of the Venice Court of appeal deals with a central issue in trust law: the legitimacy of the beneficiary of a discretionary trust to take legal action to obtain compensation for damages from the trustee.

From a theoretical and practical point of view, the ruling helps to clarify the limits of the trustee's powers and the legal position of beneficiaries of discretionary trusts, who do not have a subjective right but merely an expectation. In this way, the ruling offers a useful interpretative key for understanding the internal dynamics of the fiduciary relationship and for navigating the conflicts that may arise between trustees and beneficiaries.
