La pronuncia del Tribunale di Udine che ha ritenuto ammissibile l’opposizione di terzo proposta ex art. 619 cod. proc. civ. dalla beneficiaria del trust, divenuta proprietaria dei beni a seguito del loro pignoramento, del quale contestualmente contestava la validità è coerente con gli ultimi arresti della Suprema Corte, che ha confermato la nullità del pignoramento e della relativa trascrizione compiuti nei confronti del trust anziché del trustee nella sua qualità e, pertanto, merita di essere condivisa.

The author’s view

The ruling of the Court of Udine, which held that the third-party objection brought under Article 619 of the Code of Civil Procedure by the beneficiary of the trust, who had become the owner of the assets following their attachment – the validity of which she simultaneously contested – is consistent with the most recent rulings of the Supreme Court, which confirmed the nullity of the attachment and the related registration carried out against the trust rather than against the trustee in his or her official capacity, and therefore deserves to be endorsed.
