The author’s view
The application of the proper purpose rule to broadly drafted discretionary trusts is problematic. The approach to the rule taken by the Broad of the Privy Council in Grand View v Wong risks depriving trustees of certainty and encouraging costly and unnecessary claims and court applications.

L’applicazione della regola del proper purpose ai trust discrezionali redatti in modo ampio è problematica. L’approccio alla regola adottato dal Broad of the Privy Council nella causa Grand View v Wong rischia di privare i trustee della certezza e di incoraggiare richieste di risarcimento e domande giudiziarie costose e non necessarie.
